These terms and conditions of sale (the “Training Terms“) govern the sale of the online training courses offered on www.oh-performance.com by:
OH Performance — Olivier Hagmann, trabajador autónomo (self-employed under Spanish law) — NIF/NIE Y5704201P — Calle Blas Fernández Lirola 20, 2-1, 08902 L’Hospitalet de Llobregat, Spain — contact.ohperformance@gmail.com (the “Seller“).
OHP Apex software licences are governed by separate Licence Terms of Sale.
1. Purpose and acceptance
These Terms set out the rights and obligations of the parties when purchasing an online course on the website. Any order implies acceptance of the Terms in force on the order date, which the customer accepts by ticking the box provided before payment.
2. Courses
OH Performance offers online courses in race engineering and performance. The main characteristics of each course (content, length, access arrangements, prerequisites) are shown on its page before ordering.
3. Prices
Prices are stated in euros, including tax (Spanish VAT — IVA — at the applicable rate), unless stated otherwise. The applicable price is the one displayed when the order is confirmed.
4. Order
Access to a course requires creating an account and confirming an order on the website. The order is final once payment is confirmed. The Seller sends the customer an order confirmation by email, including these Terms.
5. Payment
Payment is made using one of the methods offered at checkout: card (via Stripe), Klarna (instalments, subject to Klarna’s approval) , bank transfer or cash on delivery. Card and Klarna payments are secured (TLS encryption) and processed directly by those providers; the Seller has no access to the customer’s full card details. For bank transfer or cash on delivery, access is opened once the funds are received.
6. Access to courses
Once payment is confirmed, the customer receives personal access to the training platform with no time limit (lifetime access). Should OH Performance stop operating the platform, customers would be informed at least 3 months in advance. Access is personal and may not be assigned, shared or resold.
7. Right of withdrawal
A consumer customer normally has 14 days to withdraw. Under Article 103 m) of Royal Legislative Decree 1/2007 (TRLGDCU) and Directive 2011/83/EU, this right does not apply to the supply of digital content not on a tangible medium once performance has begun with the customer’s prior express consent and acknowledgement that the right of withdrawal is thereby lost. This consent and acknowledgement are collected via a checkbox at checkout and confirmed in the confirmation email.
If the customer has not given this consent, they may withdraw within 14 days of the order by sending an unambiguous statement to contact.ohperformance@gmail.com; they will be refunded within 14 days using the same payment method.
8. Conformity
The Seller must supply digital content that matches its description, in accordance with Articles 114 et seq. of the TRLGDCU. In case of lack of conformity, the customer may request that it be brought into conformity and, failing that, a price reduction or termination of the contract.
9. Intellectual property
The courses, videos, materials and documents remain the exclusive property of OH Performance. They are intended for the customer’s personal use; any reproduction, distribution or exploitation without written permission is prohibited.
10. Liability
The Seller undertakes to provide courses matching their description. Content is educational; the customer remains responsible for how it is applied. The Seller’s liability cannot be excluded or limited where the law forbids it.
11. Personal data
Data collected when ordering is necessary to manage the order and access. It is processed in accordance with the website’s Privacy Policy. The customer has rights of access, rectification, erasure, objection, restriction and portability, and may complain to the AEPD (www.aepd.es).
12. Complaints and disputes
For any question or complaint: contact.ohperformance@gmail.com. These Terms are governed by Spanish law, without depriving a consumer customer of the protection of mandatory provisions of the law of their country of residence. A consumer customer may bring proceedings before the courts of their domicile. They may also use, free of charge, an out-of-court consumer dispute resolution body (in Spain: the Juntas Arbitrales de Consumo).
